Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Organic Living Sunshine Coast website, online ordering platform, and delivery services (collectively, the “Services”). By placing an order or using our Services, you agree to be bound by these Terms. Please read them carefully before proceeding.
These Terms apply to all users of our Services, including customers who browse, order online, or otherwise interact with Organic Living Sunshine Coast. If you do not agree with any part of these Terms, you must not use our Services.
We reserve the right to update these Terms at any time. Any changes will take effect immediately upon publication to our website. It is your responsibility to review these Terms regularly. Continued use of our Services constitutes acceptance of any updated Terms.
PART A — TERMS AND CONDITIONS
1. Definitions
In these Terms, unless the context otherwise requires:
• “Organic Living Sunshine Coast”, “we”, “us”, or “our” refers to the business operating under that name, its owners, employees, agents, and contractors.
• “You” or “your” refers to the customer, user, or any person who accesses or uses our Services.
• “Goods” means the organic meat, frozen products, and other organic items available for purchase through our Services.
• “Order” means a request by you to purchase Goods through our Services.
• “Delivery” means the physical delivery of Goods to your nominated address.
• “Services” means our website, online ordering platform, delivery operations, and any other services we provide.
• “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. Use of Our Services
By accessing or using our Services, you warrant and represent that:
• You are at least 18 years of age, or have the consent of a parent or guardian;
• You have the legal capacity to enter into a binding agreement;
• All information you provide to us is accurate, current, and complete;
• You are authorised to use the payment method provided; and
• Your use of our Services complies with all applicable Australian laws and regulations.
• You consent to us contacting you regarding your Order, use of our Services, and for marketing or promotional purposes, unless you have opted out of receiving such marketing or promotional material.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Notify us immediately if you become aware of any unauthorised use of your account.
We reserve the right to refuse service to any person at any time and for any reason, including where we suspect misuse, fraudulent activity, or a breach of these Terms.
3. Placing and Accepting Orders
3.1 Placing an Order
Orders may be placed through our website. When placing an order, you must provide accurate details including your name, delivery address, and payment information. By submitting an order, you are making an offer to purchase the specified Goods at the prices shown, inclusive of any applicable delivery fees and GST.
3.2 Order Acceptance
An order is accepted once:
• You have submitted your order;
• Full payment has been received and verified; and
• We have issued an order confirmation to your nominated email address.
We reserve the right to accept or reject any order, in whole or in part, for any reason including unavailability of stock, inability to verify payment, or suspicion of fraudulent activity. Where we reject or cannot fulfil an order, we will notify you and provide a full refund of any amounts paid.
3.3 Order Amendments and Cancellations
Orders may only be changed or cancelled by contacting us directly before the weekly cut-off time shown on our website. After that cut-off, orders are considered final and cannot usually be changed or cancelled.
4. Our Products
4.1 Product Suppliers
We take great care to source products from certified organic and organic suppliers. The certification status of each product will be listed in the product description.
4.2 Organic Certification
While we make every effort to ensure all products listed as “certified organic” meet organic certification standards, we cannot guarantee certification status in all circumstances. If you have specific dietary, allergy, or health requirements, please contact us before ordering.
4.3 Product Descriptions and Images
We make every effort to accurately describe and depict our products. However, appearance, weight, and presentation of Goods may vary slightly from images shown on our website. Weights and quantities are indicative only and may vary within acceptable tolerances.
4.4 Product Availability
All orders are subject to product availability. Where a product is unavailable after you have placed an order, we will notify you promptly and offer to place the product on backorder for your next delivery, or a substitute, credit, or full refund for the affected item.
4.5 Frozen and Perishable Goods
Our Goods include frozen and perishable items. At the time of delivery, frozen Goods will be maintained at a temperature compliant with Australian Food Safety Standards. It is your responsibility to appropriately store Goods upon receipt.
4.6 Product Recalls
If any Goods are subject to a recall or government ban, you agree to comply with any reasonable instructions issued by us or the relevant authority. We will notify you as soon as practicable if a recall affects an order you have received.
5. Prices and Payment
5.1 Pricing
All prices are displayed in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable. We reserve the right to vary prices at any time without notice, including in response to market fluctuations. Prices are current at the time of display and are subject to change.
5.2 Payment
Full payment is required at the time of placing your order, including any applicable delivery fees. We accept payment by the methods specified on our website. You must not attempt to pay by fraudulent or unlawful means.
It is your responsibility to ensure sufficient funds are available in your nominated account and that your payment details are accurate and up to date. You agree to notify us of any changes to your payment information.
5.3 Failed Payments
If a payment cannot be processed, we reserve the right to cancel your order.
5.4 Promotions and Discounts
Unless otherwise stated, promotional offers and discount codes cannot be used in conjunction with any other offer. We reserve the right to modify, suspend, or terminate any promotion at any time without notice, and to cancel any order to which a discount has been applied in error.
6. Delivery
6.1 Delivery Area
We currently deliver to addresses within the Sunshine Coast region, Queensland, Australia. Delivery outside this area may be available in limited circumstances; please contact us to enquire.
6.2 Delivery Fees
Delivery fees are calculated based on your order value and delivery address and will be displayed at checkout. We will advise you of any applicable delivery fee before you confirm your order.
6.3 Delivery Times
We will advise you of estimated delivery days and times when you place your order. Any delivery date or time provided is an estimate only. We will not be liable for any loss or damage arising from a delay in delivery.
6.4 Receipt of Delivery
Risk in the Goods passes to you upon Delivery to your nominated address. You are responsible for ensuring someone is available to receive the delivery, or that adequate arrangements are made for unattended delivery.
If you believe an unattended delivery may be possible, please ensure you provide specific delivery instructions when placing your order.
If there is not someone available to receive the delivery and no specific delivery instructions have been provided for unattended delivery, you order will be left at your front door.
We cannot be held responsible for any damage, deterioration, theft, or contamination of Goods left unattended where you have failed to provide adequate specific delivery instructions. In such circumstances, Goods are accepted by you as delivered, and no refund will be available.
If you have an animal at the delivery premises, it must be secured prior to the delivery driver’s arrival. Our delivery driver may refuse to enter a premises if an unsecured animal poses a risk. In this case, the Undeliverable Orders section applies.
6.5 Undeliverable Orders
If we are unable to complete delivery and the Goods are returned to us, we will contact you to provide alternate delivery options. If you refuse delivery without a valid reason, we may not issue a refund for the original order.
7. Returns and Refunds
7.1 Australian Consumer Law
Nothing in these Terms excludes your rights under the Australian Consumer Law.
7.2 Change of Mind
As our products are perishable and frozen food items, we are unable to accept returns for change of mind. Please choose carefully.
7.3 Damaged, Incorrect, or Defective Goods
If you receive Goods that are damaged, incorrect, or defective at the time of delivery, please contact us within 24–48 hours of receiving your order. We may require photographic evidence of the issue. Where we accept a claim, we will offer a replacement, credit, or refund as appropriate.
We will not accept claims for defective Goods where the issue is a result of improper storage, handling, or failure to notify us within the required timeframe.

8. Subscriptions and Recurring Orders
Where we offer a subscription or recurring order service, the following applies:
• You may pause or cancel your subscription at any time with no lock-in contract;
• Payment will be automatically debited prior to each delivery;
• It is your responsibility to maintain sufficient funds in your nominated account; and
• Any changes to pricing will be communicated to you in advance.
You may be able to manage your subscription through your online account, subject to the settings of our website and payment system.
9. Limitation of Liability
To the maximum extent permitted by law, our liability to you for any Goods purchased through our Services is limited to:
• The replacement of the Goods or re-supply of equivalent goods; or
• A refund of the purchase price paid for those Goods.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of use, however caused, whether in contract, tort (including negligence), statute, or otherwise.
We will not be liable for any loss or damage arising from:
• Incorrect information supplied by you;
• Delays in delivery or failure to deliver due to events outside our reasonable control;
• Deterioration of Goods after delivery due to your failure to store them appropriately;
• Damage or theft of Goods after delivery to your nominated address;
• Your reliance on any information published on our website;
• Third-party links or external websites accessible from our site; or
• Any act of God, natural disaster, pandemic, labour dispute, or other event beyond our control.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot be excluded.
10. Indemnity
You agree to indemnify, defend, and hold harmless Organic Living Sunshine Coast, its owners, employees, agents, and contractors from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
• Your use of our Services;
• Your breach of these Terms;
• Your violation of any applicable law or the rights of any third party; or
• Any fraudulent activity or misrepresentation on your part.
11. Intellectual Property
All content on our website and associated materials, including but not limited to text, graphics, images, logos, trademarks, and product descriptions, is the property of Organic Living Sunshine Coast or its licensors and is protected by copyright, or other applicable intellectual property laws.
You may view and use our website content for personal, non-commercial purposes only. You must not reproduce, modify, distribute, transmit, republish, or otherwise exploit any content from our website without our prior written consent.
12. Website Use and Prohibited Conduct
By using our website, you agree not to:
• Use the website for any unlawful or unauthorised purpose;
• Interfere with or disrupt the operation of the website or any connected servers;
• Attempt to gain unauthorised access to any part of our Services or systems;
• Transmit any viruses, malware, or other harmful code;

We will not be in breach of these Terms or liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather, pandemic, supply chain disruption, power failure, government restrictions, or any other event beyond our reasonable control.
15. Amendments to These Terms
We reserve the right to amend these Terms at any time. Changes will be effective immediately upon publication to our website. We will endeavour to notify you of significant changes by email, but it remains your responsibility to check these Terms regularly. Your continued use of our Services after any change constitutes your acceptance of the updated Terms.
16. General Provisions
Entire Agreement
These Terms constitute the entire agreement between you and Organic Living Sunshine Coast in relation to the subject matter and supersede any prior agreements, representations, or understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
Waiver
Any failure or delay by us to exercise a right under these Terms does not constitute a waiver of that right.
Relationship
These Terms do not create an agency, partnership, joint venture, or employment relationship between you and us.
Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising under or in connection with these Terms.
Dispute Resolution
In the event of a dispute, we encourage you to contact us first to seek an informal resolution. If the dispute cannot be resolved informally, either party may refer the matter to mediation before commencing legal proceedings, except where urgent injunctive relief is required.
